Kashmir LIVE: In an announcement with massive repercussions for Jammu and Kashmir, Home Minister Amit Shah has announced in Rajya Sabha that the government has decided to repeal Article 370 of the Constitution which grants special status to J&K. The government has also decided to bifurcate the state into two Union territories – Jammu and Kashmir, which will have a legislature, and Ladakh, which will be without a legislature.

As per the order, there will be no movement of public and all educational institutions shall also remain closed. There will be a complete bar on holding any kind of public meetings or rallies during the period of operation of this order.

The TDP president, Chandrababu Naidu, announces his support to the Union government as it seeks to repeal Article 370.  The BSP, AAP, AIADMK, BJD and the YSRCP also announced support for the government in the Rajya Sabha.

NSA Ajit Doval is expected to visit Kashmir valley today along with other senior security officials to review the situation on ground. NSA Doval had earlier visited Srinagar in last week of July before the implementation of decision to revoke Article 370, news agency ANI reported.

Opposing the scrapping of Article 370 and the bifurcation of Jammu and Kashmir into two Union Territories, leader of Oppositon Ghulam Nabi Azad said in the Rajya Sabha, " Shameful that you have turned J&K into a non entity by making a Lt Governor there, so that you can appoint even a peon or a clerk, sitting here (Delhi). "


Pakistan Prime Minister Imran Khan's PTI has officially codemned the announcements made by India on abolishing Article 370, saying that no unilateral step by the Government of India can change this disputed status, as enshrined in the United Nations Security Council (UNSC) resolutions.

Veteran BJP leader LK Advani expressed his happiness on the government's  decision to revoke Article 370, saying that it is a bold step towards strengthening national integration. "The scrapping of Article 370 has been a part of BJP’s core ideology since the days of Jan Sangh. I congratulate the Prime Minister Shri Narendra Modi and the Home Minister Shri Amit Shah for this historic initiative and pray for peace, prosperity and progress in Jammu, Kashmir and Ladakh," he adds.

Apart from abolishing Article 370, the government has also said it wants parliament to clear a proposal that bifurcates the state of Jammu and Kashmir into two union territories which are effectively semi-states. Jammu and Kashmir would be one union territory with its own legislature, like Delhi; Ladakh would be the other but without its own assembly.

Pak Condemns Move | Ministry of Foreign Affairs of Pakistan has issued a statement in response to India's move to remove Article 370 on Jammu and Kashmir. "Pakistan strongly condemns and rejects the announcements made today by the Indian Government regarding the Indian Occupied Jammu & Kashmir," the statement reads, adding that the region is an internationally recognised 'disputed territory' as recognised by the UNSC and no unilateral step by the Indian govt can change this."

Security Forces on High Alert | All security forces formations in the country, specifically in Jammu and Kashmir, are on 'high alert' following the government revoking Article 370 from Jammu and Kashmir, officials said on Monday.

'Insaniyat, jamhuriat, kashmiriyat' -- each of these principles have been violated by the government's resolution on Article 370, writes Yogendra Yadav.


The Jammu and Kashmir Reorganisation Bill, which is expected to be passed in Rajya Sabha today, will be brought to Lok Sabha tomorrow.


Disintegration of India has Begun, Says Chidambaram | Senior Congress leader P Chidambaram said that by bringing a resolution on Article 370, the disintegration of India has begun. "The govt has illegally disintegrated J&K...this will set a precedent and allow the govt to disintegrate any state as per its will and we will not stand by this," he says.


The Jammu and Kashmir unit of the BJP on Monday welcomed the government's "historic" decision on Article 370 of the Constitution, which grants special status to the state, saying the people were thankful to Prime Minister Narendra Modi for "mitigating their pain"

- The special status given through the constitution to Kashmir has ended, the government said today after Home Minister Amit Shah informed parliament that Article 370 has been abolished with the President signing an order that comes into effect "at once."

- The announcement came after Prime Minister Narendra Modi held a meeting of his cabinet at his house this morning.

-Article 370 gives Jammu and Kashmir its own constitution and decision-making rights for all matters barring defence, communications and foreign affairs.

- The removal of this part of the constitution ends special status for Kashmir, which was key to its accession to India in 1947.

- The government has also said it wants parliament to clear a proposal that bifurcates the state of Jammu and Kashmir into two union territories which are effectively semi-states. Jammu and Kashmir would be one union territory with its own legislature, like Delhi; Ladakh would be the other but without its own assembly.

- Shah said that the govt proposed for the UT status for Jammu and Kashmir on the basis of on an assessment of the "prevailing security situation" fueled by cross-border terrorism.

- Article 370 made it necessary for the centre to get the state legislature's approval for introducing any policies or constitutional powers to the state.​ This in turn means that the Governor, who is being treated as the 'State' govt at the moment, was able to move the resolution to the President. So, 370 will be abrogated by prez order in conjunction with passage and ratification by Parliament by a simple majority.


JDU Opposes Resolution on 370 | BJP's ally, JDU has said that it will not support the resolution on Article 370.  "Our chief Nitish Kumar is carrying forward the tradition of JP Narayan, Ram Manohar Lohia and George Fernandes. So our party is not supporting the Bill moved in the Rajya Sabha today. We have different thinking. We want that Article 370 should not be revoked," KC Tyagi of the JDU was quoted as saying by news agency ANI.


AAP, too, has extended its support to the Centre's resolution on removing Article 370, with its chief Arvind Kejriwal stating that the party hopes "this will bring peace and development in the state"


Which Parties Support Govt on Removal of 370? BJD, YSRCP. BSP, AIADMK, Shiv Sena and BPF (Assam) have supported the Centre's resolution on Article 370. BJD MP Prasanna Acharya in Rajya Sabha said, "In real sense today, Jammu & Kashmir has become a part of India. My party supports this resolution. We are a regional party but for us nation is first."


Indian Army and Indian Air Force have been put on high alert, following revoking of Article 370 and other decisions announced by Government of India, news agency ANI reported.

Delhi Metro on Red Alert | "As advised by security agencies, a red alert has been imposed on the entire DMRC network. Please allow extra time in security checks," the DMRC said.

Omar Abdullah Issues Statement, Says Move a Betrayal to People | Former chief minister of Jammu and Kashmir and National Conference leader Omar Abdullah has deemed the govt's move of removing Article 370 as a betrayal of trust of the people of the Valley, a move which will have 'far reaching and dangerous' consequences.


"Historic day for India. 370 scrapped and Jammu & Kashmir now truly a part of India. The path to a safer, progressive and an open J&K determined by citizens, and not anti national separatists has been paved," Shiv Sena leader Aditya Thackeray tweeted.


How Was Fate of Article 370 Sealed | President under Article 370, Section (3) can issue proclamation to annul Article 370 with concurrence J&K constituent assembly. Ram Nath Kovind today issued proclamation that since constituent assembly no longer remains,so J&K assembly would mean same. Since there is no J&K assembly as of today, hence all powers of the state assembly reside in two houses of Parliament. Hence, annulling Article 370 can be done with concurrence of simple majority of both houses of Parliament (and not 2/3rd).


More Troops Sent to Kashmir | Hours after Section 144 CrPc was imposed in Srinagar, after which Home Minister Amit Shah scrapped Article 370 from Indian Constitution, close to 8,000 paramilitary troops were airlifted and moved in from Uttar Pradesh, Odisha, Assam and other parts of the country to the Kashmir valley. Historical Blunder Corrected, Says Jaitley | Former Finance Minister Arun Jaitley hailed the government's decision to remove Article 370 and showered praises at PM and Shah for 'correcting a historical blunder'. "A historical wrong has been undone today. Article 35A came through the back door without following the procedure under Article 368 of the Constitution of India. It had to go," he says.


With issuance of presidential Order, the NDA government has resorted to legal interpretations of the constitutional provisions to do away with Article 370, which granted special and autonomous status to Jammu and Kashmir.

- The presidential order brought about changes in the text of the Constitution to imply that henceforth, all provisions of the Constitution shall now apply also to J&K.

- "All provisions of the Constitution, as amended from time to time, shall apply in relation to the State of Jammu and Kashmir and the exceptions and modifications subject to which they shall so apply..." stated the order, notified on Monday.

Since there is no elected government in place at this time in J&K, the presidential order states that the Governor shall exercise the powers of the elected government and will express the will of the state legislature in making recommendations to the President in relation to Article 370.

Making the announcement on bifurcation of Jammu and Kashmir in Rajya Sabha, Union Home Minister Amit Shah said the UT in Ladakh will have no legislature like Chandigarh while the other UT of Jammu and Kashmir will have a legislature like Delhi and Puducherry. Shah introduced the Jammu and Kashmir Reorganisation bill.


'Glorious day,' writes Ram Madhav |  BJP leader Ram Madhav on Monday hailed the government's decision on Article 370 in Jammu and Kashmir and said the martyrdom of its idealogue Dr Shyama Prasad Mukherjee for complete integration of the state into India has been "honoured".
    The national general secretary and the party's point person in the state said that the complete integration of Jammu and Kashmir was a longstanding demand of the nation.

Shah’s announcement was immediately followed by massive uproar in the Upper House with opposition MPs protesting in the Well of the House. Back in the Valley, three of Jammu and Kashmir's most prominent politicians — Mehbooba Mufti, Omar Abdullah and Sajjad Lone are under house arrest amid a massive security-built up in the state. Internet services and mobile services have been suspended in several places and all public gatherings are banned in Srinagar district as section 144 was imposed from midnight.

After the Jammu and Kashmir administration curtailed the Amarnath Yatra and asked pilgrims and tourists to leave the Valley at the earliest on Friday, anxious residents continue to throng markets to stock on essentials and serpentine queues have been visible outside shops and fuel stations.

The Anantnag district administration, in view of "panic stocking", ordered all fuel station dealers not to sell petrol or diesel without permission from the district magistrate or an authorised officer.

Various educational institutions in Kashmir Valley also directed their students to vacate hostels. The authorities in Jammu and Udhampur district also ordered closure of schools and colleges as precautionary measures.

The University of Jammu will remain closed on Monday and all scheduled examinations have been postponed. The authorities have imposed night curfew in Kishtwar, Rajouri districts and Banihal area of Ramban district.

Additional paramilitary forces, which arrived in Kashmir in the past few days, have been deployed across the city and in other vulnerable areas of the valley, the officials said.

The strength of the security personnel has been increased around vital installations such as the civil secretariat, police headquarters, airport and various central government establishments in the city, they said.

Barricades have been erected on many arterial roads, including the entry and exit points to Srinagar, the summer capital of the state.

Riot control vehicles have also been kept on standby in some areas where apprehension of law and order disturbances is more, the officials added.

In Delhi, Union Home Minister Amit Shah held a meeting with top security officials on Sunday and is believed to have discussed the prevailing situation in Jammu and Kashmir, officials said.

The hour-long meeting was attended by National Security Advisor Ajit Doval, Union Home Secretary Rajiv Gauba and other senior officials.

Political parties in Jammu Kashmir had expressed apprehensions about such action after the Centre deployed additional troops and curtailed the Amarnath Yatra.

Jammu and Kashmir Governor SP Malik had earlier dismissed speculations that the Centre might be planning to do away with Article 35A of the Constitution, which gives exclusive rights to the state's residents in government jobs and land.
